1. Acceptance of Terms

By downloading, installing, or using the CutLoose mobile application ("App"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and CutLoose ("we," "us," or "our").

2. Eligibility

2.1 Age Requirement

You must be at least 13 years old to use CutLoose. In some jurisdictions, you must be 17+ due to the addiction-related content.

By using the App, you represent and warrant that you meet the age requirements.

2.2 Parental Consent

If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use CutLoose and agree to these Terms.

3. Description of Service

3.1 What CutLoose Provides

CutLoose is a personal recovery and sobriety tracking application that offers:

• Daily logging of recovery progress
• Craving management tools and interventions
• Progress tracking and analytics
• Achievement badges and milestones
• Weekly review and insights
• Pattern recognition and recommendations

3.2 Free and Pro Tiers

Free Tier:

• Access to core features
• Ad-supported experience
• Watch ads before daily logging and badge sharing
• Crisis intervention tools (always free)

Pro Tier (paid subscription):

• Ad-free experience
• Advanced analytics and trends
• Unlimited badge visibility
• Extended history access
• Data export capabilities

4. Medical Disclaimer

You acknowledge and agree that:

• Always seek the advice of qualified healthcare professionals for medical questions
• Never disregard professional medical advice or delay seeking it because of something you read in CutLoose
• If you are experiencing a medical emergency or mental health crisis, call emergency services (911 in the US) immediately
• CutLoose is designed to complement, not replace, professional treatment and support

5. User Conduct and Responsibilities

5.1 Acceptable Use

You agree to use CutLoose only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Use the App to harm, threaten, or harass others
• Share or distribute content from the App without permission

5.2 Your Data and Privacy

You are responsible for:

• The accuracy of information you enter into the App
• Maintaining the security of your device
• Backing up your data (we do not provide cloud backup)
• Understanding that deleting the App permanently erases all your data

6. Subscriptions and Payments

6.1 Subscription Tiers

CutLoose Pro is available through the following subscription options:

• Monthly Subscription: $9.99/month
• Yearly Subscription: $79.99/year (save 33%)
• Lifetime Purchase: $199.99 one-time payment

Additional options:

• 24-Hour Day Pass: $0.99 for 24 hours of Pro access
• Sponsored Pass: Watch a rewarded ad for 24 hours of free Pro access (limited to once per day)

6.2 Payment Processing

All payments are processed through Apple's App Store using Apple's in-app purchase system. By purchasing a subscription, you agree to Apple's Terms of Service and payment policies.

6.3 Auto-Renewal

Important: Monthly and yearly subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

You will be charged for renewal within 24 hours prior to the end of the current period at the same price you originally paid.

6.4 Cancellation

You can cancel your subscription at any time through:

• iPhone: Settings → [Your Name] → Subscriptions → CutLoose → Cancel Subscription
• CutLoose App: Settings → Manage Subscription

Cancellation takes effect at the end of your current billing period. You will continue to have access until then.

6.5 Refunds

Refunds are handled by Apple according to their refund policy. We do not process refunds directly.

To request a refund:

• Go to reportaproblem.apple.com
• Sign in with your Apple ID
• Find CutLoose purchase and request refund

Note: Refunds are not guaranteed and are granted at Apple's sole discretion.

6.6 Price Changes

We reserve the right to change subscription prices at any time. Price changes will:

• Be communicated at least 30 days in advance
• Only affect new subscriptions or renewals after the notice period
• Not affect existing subscribers until their next renewal

7. Intellectual Property

7.1 Ownership

CutLoose and all its content, features, and functionality (including but not limited to design, text, graphics, logos, and software) are owned by us and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use CutLoose for personal, non-commercial purposes, subject to these Terms.

7.3 Your Content

You retain ownership of all data and content you create in CutLoose (daily logs, notes, etc.). We do not claim ownership of your personal recovery data.

Since your data stays on your device and is never uploaded to our servers, we have no access to or control over your content.

8. Third-Party Services

8.1 AdMob (Google)

Free users will see ads provided by Google AdMob. These ads are subject to Google's terms and privacy policies. We are not responsible for the content or practices of third-party advertisers.

8.2 App Store (Apple)

CutLoose is distributed through Apple's App Store and subject to Apple's terms of service. Your use of the App Store is governed by Apple's agreements, not these Terms.

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Basis

CutLoose is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of content

9.2 No Guarantees

We do not guarantee that:

• CutLoose will meet your recovery goals or expectations
• The App will be uninterrupted, timely, secure, or error-free
• The results from using the App will be accurate or reliable
• Any defects in the App will be corrected

9.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage
• Relapse or setbacks in your recovery journey

Our total liability to you for any claim arising from your use of CutLoose shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is less.

9.4 Recovery Outcomes

10. Indemnification

You agree to defend, indemnify, and hold harmless CutLoose and its owners, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

11. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue any feature of CutLoose at any time
• Release updates and new versions
• Change pricing for future subscriptions

We will make reasonable efforts to notify you of significant changes through in-app notifications or the App Store.

12. Termination

12.1 Your Right to Terminate

You may stop using CutLoose at any time by:

• Deleting the App from your device
• Cancelling your subscription (if applicable)

12.2 Our Right to Terminate

We reserve the right to suspend or terminate your access to CutLoose if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse or misuse the App

12.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• All data on your device remains yours (we cannot delete it remotely)
• Active subscriptions may continue until the end of the billing period

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing any legal claim, you agree to first contact us at support@cutlooseapp.com to attempt to resolve the dispute informally. We will work in good faith to resolve your concern.

13.3 Arbitration

If we cannot resolve a dispute informally, any dispute arising from these Terms or your use of CutLoose shall be resolved through binding arbitration, except that you may assert claims in small claims court if they qualify.

You agree to waive your right to a jury trial and to participate in a class action lawsuit.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CutLoose regarding the App.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.

14.5 Changes to Terms

We may update these Terms from time to time. Changes will be effective when posted in the App. Material changes will be communicated through:

• In-app notification
• Update to the "Last Updated" date
• Email (if we have your email from support inquiries)

Your continued use of CutLoose after changes constitutes acceptance of the updated Terms.
